These Terms of Service (“Terms”) govern your access to and use of the website located at www.bemyeyesfoundation.org (the “Site”) operated by the Be My Eyes Foundation, a California nonprofit public benefit corporation (“Foundation,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. About the Foundation
The Be My Eyes Foundation is organized and operated exclusively for charitable, educational, and scientific purposes. The Foundation’s mission is to advance accessibility, independence, and full participation in society for people who are blind or have low vision. The Foundation develops and supports assistive technologies, conducts accessibility research, provides educational programs, and works to eliminate barriers to information and digital access for blind and low-vision individuals worldwide.
The Foundation does not sell products or provide services to website visitors at this time. The Site is operated to (i) inform the public about the Foundation’s charitable purposes and activities, and (ii) accept charitable donations in support of those purposes.
2. Eligibility
The Site is available to individuals who are at least 18 years of age or who are making a donation with the knowledge and consent of a parent or guardian. By using the Site, you represent that you meet this requirement.
Donations may be accepted from donors located anywhere in the world, subject to applicable legal requirements. The Foundation reserves the right to decline or refund any donation in its sole discretion.
3. Charitable Donations
3.1 General
The Foundation is applying for recognition as a tax-exempt public charity under Section 501(c)(3) of the Internal Revenue Code. If the IRS approves our application and recognizes our exemption, donations made now generally will be tax-deductible to the extent permitted by law. However, because our application has not yet been approved, donors do not currently have assurance that their contributions are tax-deductible.
3.2 One-Time and Recurring Gifts
The Site offers the following donation options:
- One-Time Donations: a single charitable gift processed at the time of your transaction.
- Recurring Monthly Donations: an ongoing charitable gift processed on approximately the same calendar date each month.
- Recurring Annual Donations: an ongoing charitable gift processed on approximately the same calendar date each year.
By clicking the applicable donation button on our site and submitting your payment information, you authorize the Foundation (or its designated payment processor) to charge your designated payment method. Donations are processed in USD unless otherwise indicated during checkout.If you select a recurring monthly or recurring annual donation, (i) you authorize us and our payment processor to charge your payment method automatically every month (or every year, as selected) until you cancel, and (ii) you authorize us and our payment processor to obtain and use updated payment credentials made available by your card issuer or payment network to continue processing your recurring donation unless you cancel. If a recurring payment cannot be processed, we may make one or more additional attempts to process the donation, or we may contact you to update your payment information.You may cancel a recurring donation at any time by contacting us at . There is no cancellation fee. Cancellations submitted before the next scheduled processing date will take effect for that period; cancellations submitted on or after the processing date will take effect for the following period.For annual recurring donations, we may send a reminder before your next annual charge, including the amount to be charged and instructions for cancellation, where required by applicable law.
3.3 Payment Processing
All payment transactions are processed by third-party payment processors. The Foundation does not collect or store payment card information. Payment processing is subject to the terms and privacy policy of the applicable payment processor. The Foundation is not responsible for errors or failures in payment processing, except to the extent required by applicable law.
3.4 Donation Screening and Legal Compliance
To comply with applicable law and to protect the integrity of the Foundation’s charitable activities, we may review donations for fraud prevention, identity verification, sanctions compliance, anti-money laundering compliance, and other legal or regulatory purposes. We reserve the right to decline, suspend, return, or refund any donation where we reasonably believe it may violate applicable law, expose the Foundation to legal or regulatory risk, or involve fraud or other improper activity.
3.5 Refunds
Donations are generally non-refundable, as they are promptly committed to charitable purposes. However, the Foundation may, in its sole discretion, provide a refund in the event of a documented processing error or other exceptional circumstance. Refund requests must be submitted to [email protected] within 30 days of the transaction date.
3.6 Non-U.S. Donors
Donors located outside the United States are responsible for ensuring that their donation complies with the laws of their jurisdiction, including any restrictions on charitable giving or currency transfers. The Foundation makes no representation regarding the tax treatment of donations under non-U.S. law.
4. Acceptable Use
You agree to use the Site only for lawful purposes consistent with these Terms. You agree not to:
- Use the Site in any manner that could disable, overburden, damage, or impair it, or interfere with any other party’s use.
- Attempt to gain unauthorized access to any portion of the Site or any connected system or network.
- Use automated means—including bots, spiders, or scrapers—to access the Site without express written permission from the Foundation.
- Submit false, misleading, or fraudulent information in connection with any donation or other interaction.
- Transmit any material that is unlawful, harassing, defamatory, obscene, or otherwise objectionable.
- Violate any applicable local, state, national, or international law or regulation.
5. Intellectual Property
All content on the Site, including text, graphics, logos, and other materials, is the property of the Foundation or its content licensors and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Site or its content.
You may view, download, and print materials from the Site for personal, non-commercial purposes, provided you do not remove any proprietary notices. Any other use requires the Foundation’s prior written consent.
6. Third-Party Links
The Site may contain links to third-party websites as a convenience to users. The Foundation does not control, endorse, or assume responsibility for such sites or their content, privacy practices, or terms of use. We encourage you to review the terms and privacy policies of any third-party sites you visit.
7. Disclaimer of Warranties
**The site and its contents are provided “as is” and “as available,” without warranties of any kind, express or implied. To the fullest extent permitted by applicable law, the Foundation disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, title, and non-infringement. The Foundation does not warrant that the site will be uninterrupted, error-free, or free of viruses or other harmful components.**
8. Limitation of Liability
**To the fullest extent permitted by applicable law, in no event shall the Foundation, its directors, officers, employees, agents, or volunteers be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the site, even if advised of the possibility of such damages. In no event shall the Foundation’s total liability exceed the greater of (a) the amount of your most recent donation and (b) one hundred U.S. dollars (USD $100).**

9. Indemnification
You agree to indemnify, defend, and hold harmless the Foundation and its directors, officers, employees, agents, and volunteers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with (a) your access to or use of the Site, (b) your violation of these Terms, or (c) your violation of any applicable law or the rights of any third party.
10. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Site that cannot be resolved informally shall be submitted to binding arbitration administered by JAMS in San Francisco, California, under its Streamlined Arbitration Rules, except that either party may seek injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm.
EU and UK visitors: nothing in these Terms limits any rights you may have under the laws of the European Union or United Kingdom, including mandatory consumer protection provisions.
11. Changes to These Terms
The Foundation reserves the right to modify these Terms at any time. We will post the updated Terms on the Site with a revised effective date. Your continued use of the Site after such posting constitutes your acceptance of the updated Terms.
